Article L112-7 of the French Consumer Code

Any operator of a voice communications service within the meaning of 7° and 15° of Article L. 32 of the French Post and Electronic Communications Code is obliged to offer consumers, when they subscribe to a voice communications service, an offer in which calls from the network to which the consumer has been connected by his operator and to the national territory are billed by the second, from the first second, excluding any fixed connection costs.

Consumers who have opted for a voice communications service are entitled to a fixed connection charge, which is billed by the second, from the first second, excluding any fixed connection charges.

Consumers who have opted for a prepaid payment method are billed per second, from the first second, for their voice telephony calls from the network to which the consumer has been connected by his operator and to the national territory. Tout opérateur de service de communications vocales au sens des 7° et 15° de l’article L. 32 du code des postes et des communications électroniques est tenu de proposer de manière équitable au consommateur, lors de la souscription d’un service de communications vocales, une offre dans laquelle les communications au départ du réseau auquel le consommateur a été raccordé par son opérateur et à destination du territoire national sont facturées à la seconde, dès la première seconde, hors éventuellement un coût fixe de connexion.

Les consommateurs ayant opté pour un mode de règlement prépayé bénéficient d’une facturation à la seconde, dès la première seconde, de leurs communications de téléphonie vocale au départ du réseau auquel le consommateur a été raccordé par son opérateur et à destination du territoire national. Ces consommateurs peuvent bénéficier, sur demande, de tout autre mode de facturation proposé par l’opérateur.

Le présent article ne s’applique pas aux appels vers les numéros pouvant être surtaxés.
