Article L112-7 of the French Monetary and Financial Code

Infringements of articles L. 112-6 to L. 112-6-2 are recorded by agents designated by order of the Minister responsible for the budget. The debtor or the court-appointed agent having made a payment in breach of the same articles L. 112-6 to L. 112-6-2 are liable to a fine, the amount of which is set taking into account the seriousness of the breaches and which may not exceed 5% of the sums paid in breach of the aforementioned provisions. The debtor and the creditor are jointly and severally liable for payment of this fine in the event of a breach of articles L. 112-6 and L. 112-6-1.

Les infractions aux articles L. 112-6 à L. 112-6-2 sont constatées par des agents désignés par arrêté du ministre chargé du budget. Le débiteur ou le mandataire de justice ayant procédé à un paiement en violation des mêmes articles L. 112-6 à L. 112-6-2 sont passibles d’une amende dont le montant est fixé compte tenu de la gravité des manquements et qui ne peut excéder 5 % des sommes payées en violation des dispositions susmentionnées. Le débiteur et le créancier sont solidairement responsables du paiement de cette amende en cas d’infraction aux articles L. 112-6 et L. 112-6-1.
