Article L1121-8-1 of the French Public Health Code

Persons who are not affiliated to a social security scheme or who are beneficiaries of such a scheme may be asked to take part in non-interventional research.

By way of derogation, the Personal Data Protection Committee may authorise a person who is not affiliated to a social security scheme or is the beneficiary of such a scheme to take part in the research mentioned in 1° or 2° of article L. 1121-1. Reasons must be given for this authorisation. It must be based on at least one of the following conditions:

1° The importance of the expected benefit for these persons is such as to justify the foreseeable risk incurred;

2° This research is justified with regard to the expected benefit for other persons in the same legal situation. In this case, the foreseeable risk and the constraints involved in the research must be minimal.

Article L1121-8-1

Les personnes qui ne sont pas affiliées à un régime de sécurité sociale ou bénéficiaires d’un tel régime peuvent être sollicitées pour se prêter à des recherches non interventionnelles.

A titre dérogatoire, le comité de protection des personnes peut autoriser une personne qui n’est pas affiliée à un régime de sécurité sociale ou bénéficiaire d’un tel régime à se prêter à des recherches mentionnées aux 1° ou 2° de l’article L. 1121-1. Cette autorisation est motivée. Elle doit se fonder au moins sur l’une des conditions suivantes :

1° L’importance du bénéfice escompté pour ces personnes est de nature à justifier le risque prévisible encouru ;

2° Ces recherches se justifient au regard du bénéfice escompté pour d’autres personnes se trouvant dans la même situation juridique. Dans ce cas, le risque prévisible et les contraintes que comporte la recherche doivent présenter un caractère minime.
