By way of exception to 2° of article L. 113-2, when the purpose of the insurance contract is to guarantee, in the event of the occurrence of one of the risks defined in the contract, either the total or partial repayment of the amount outstanding under a credit agreement referred to in 1° of article L. 313-1 of the French Consumer Code, or the payment of all or part of the instalments on the said loan, the insurer may not request any information relating to the insured person’s state of health or medical examination, provided that all of the following conditions are met:
1° The insured party’s share of the total outstanding credit does not exceed 200,000 euros per insured party;
2° The instalment due date for repayment of the credit contracted is before the insured party’s sixtieth birthday.
A decree of the Conseil d’Etat may define more favourable conditions for the policyholder in terms of the maximum percentage insured and the policyholder’s age.
