Article L122-2 of the French Insurance Code

The insurer shall only be liable for material damage resulting directly from the fire or the outbreak of fire, unless otherwise agreed.

If the expert assessment is not completed within three months of the date of submission of the statement of losses, the insured has the right to claim interest by summons; if it is not completed within six months, either party may take legal action.

Les dommages matériels résultant directement de l’incendie ou du commencement d’incendie sont seuls à la charge de l’assureur, sauf convention contraire.

Si, dans les trois mois à compter de la remise de l’état des pertes, l’expertise n’est pas terminée, l’assuré a le droit de faire courir les intérêts par sommation ; si elle n’est pas terminée dans les six mois, chacune des parties peut procéder judiciairement.
