Article L122-23 of the French Consumer Code

Any advertising relating to the acquisition of housing intended for rental and likely to benefit from the provisions of articles 199 tervicies, 199 sexvicies and 199 novovicies of the French General Tax Code:

1° Provides a reasonable understanding of the risks associated with the investment;

2° Includes a statement indicating that failure to comply with the rental commitments will result in the loss of tax incentives, which must :

a) Appear in a font size at least as large as that used to indicate any other information relating to the characteristics of the investment;

b) Be included in the main body of the advertising text.

Any breach of the provisions of this article is subject to an administrative fine of up to €100,000.

The fine shall be imposed in accordance with the conditions laid down in Chapter II of Title II of Book V of this Code.

Toute publicité relative à une opération d’acquisition de logement destiné à la location et susceptible de bénéficier des dispositions prévues aux articles 199 tervicies, 199 sexvicies et 199 novovicies du code général des impôts :


1° Permet raisonnablement de comprendre les risques afférents à l’investissement ;


2° Comporte une mention indiquant que le non-respect des engagements de location entraîne la perte du bénéfice des incitations fiscales, qui doit :


a) Figurer dans une taille de caractères au moins aussi importante que celle utilisée pour indiquer toute autre information relative aux caractéristiques de l’investissement ;


b) S’inscrire dans le corps principal du texte publicitaire.


Tout manquement aux dispositions du présent article est passible d’une amende administrative dont le montant ne peut excéder 100 000 €.


L’amende est prononcée dans les conditions prévues au chapitre II du titre II du livre V du présent code.
