Article L1226-24 of the French Labour Code

A sales clerk who, as a result of an accident for which he is not at fault, is unable to perform his employment contract is entitled to his salary for a maximum period of six weeks.

During this period, compensation paid by an insurance company or a mutual insurance company is not deducted from the amount of remuneration due by the employer. Any stipulation to the contrary is null and void.

A commercial clerk is an employee who, employed by a trader within the meaning of Article L. 121-1 of the French Commercial Code, performs commercial duties in the service of customers.

Le commis commercial qui, par suite d’un accident dont il n’est pas fautif, est dans l’impossibilité d’exécuter son contrat de travail a droit à son salaire pour une durée maximale de six semaines.

Pendant cette durée, les indemnités versées par une société d’assurance ou une mutuelle ne sont pas déduites du montant de la rémunération due par l’employeur. Toute stipulation contraire est nulle.

Est un commis commercial le salarié qui, employé par un commerçant au sens de l’article L. 121-1 du code de commerce, occupe des fonctions commerciales au service de la clientèle.
