Article L1233-46 of the French Labour Code

The employer shall notify the administrative authority of any plan to make redundancies for economic reasons affecting at least ten employees within the same thirty-day period.

Where the company has staff representatives, notification is made at the earliest the day after the date scheduled for the first meeting provided for in articles L. 1233-29 and L. 1233-30.

The notification shall be accompanied by all information concerning the convening, agenda and holding of this meeting. No later than this date, it shall indicate, where applicable, the employer’s intention to open the negotiations provided for in article L. 1233-24-1. The mere fact of opening such negotiations before this date may not constitute an obstacle to the operation of the social and economic committee.

Article L1233-46

L’employeur notifie à l’autorité administrative tout projet de licenciement pour motif économique d’au moins dix salariés dans une même période de trente jours.

Lorsque l’entreprise est dotée de représentants du personnel, la notification est faite au plus tôt le lendemain de la date prévue pour la première réunion prévue aux articles L. 1233-29 et L. 1233-30.

La notification est accompagnée de tout renseignement concernant la convocation, l’ordre du jour et la tenue de cette réunion. Au plus tard à cette date, elle indique, le cas échéant, l’intention de l’employeur d’ouvrir la négociation prévue à l’article L. 1233-24-1. Le seul fait d’ouvrir cette négociation avant cette date ne peut constituer une entrave au fonctionnement du comité social et économique.
