When the administrative authority detects a procedural irregularity in the course of the checks it carries out, it sends the employer a notice specifying the nature of the irregularity found. At the same time, it sends a copy of its observations to the social and economic committee.
The administrative authority may make observations on the social measures provided for in article L. 1233-32.
The employer responds to the observations of the administrative authority and sends a copy of its response to the employee representatives. If this response is made after the deadline for sending the letters of dismissal provided for in article L. 1233-39, the deadline is postponed until the date on which the response is sent to the administrative authority. Letters of dismissal may only be sent to employees from this date.
