Article L1233-70 of the French Labour Code

A multi-year agreement between the State and representative employee and employer trade unions at national and cross-industry level sets out the procedures for organising the back-to-work pathway referred to in article L. 1233-65 and for implementing, monitoring and evaluating the measures it includes. This agreement determines in particular the responsibilities of the State’s territorial representatives in this implementation and the procedures for appointing the operators responsible for this.

A multi-year agreement between the State and the body responsible for managing the unemployment insurance scheme referred to in Article L. 5427-1 sets out the funding arrangements for the back-to-work pathway referred to in Article L. 1233-65 and the measures it includes. A financial appendix is negotiated annually between the State and the body responsible for managing the unemployment insurance scheme mentioned in article L. 5427-1.

In the absence of such agreements, the provisions which they must include are determined by decree of the Conseil d’Etat.

Article L1233-70

Une convention pluriannuelle entre l’Etat et des organisations syndicales de salariés et d’employeurs représentatives au niveau national et interprofessionnel détermine les modalités de l’organisation du parcours de retour à l’emploi mentionné à l’article L. 1233-65 et de la mise en œuvre, du suivi et de l’évaluation des mesures qu’il comprend. Cette convention détermine notamment les attributions des représentants territoriaux de l’Etat dans cette mise en œuvre et les modalités de désignation des opérateurs qui en sont chargés.

Une convention pluriannuelle entre l’Etat et l’organisme chargé de la gestion du régime d’assurance chômage mentionné à l’article L. 5427-1 détermine les modalités de financement du parcours de retour à l’emploi mentionné à l’article L. 1233-65 et des mesures qu’il comprend. Une annexe financière est négociée annuellement entre l’Etat et l’organisme chargé de la gestion du régime d’assurance chômage mentionné à l’article L. 5427-1.

A défaut de ces conventions, les dispositions qu’elles doivent comporter sont déterminées par décret en Conseil d’Etat.
