Article L1237-19-5 of the French Labour Code

The administrative authority competent to take the validation decision is that of the place where the company or establishment concerned by the draft agreement on collective redundancy is established. If the draft agreement on the collective termination of employment contracts concerns establishments under the jurisdiction of different authorities, the competent administrative authority is designated under the conditions laid down by decree in the Conseil d’Etat.

L’autorité administrative compétente pour prendre la décision de validation est celle du lieu où l’entreprise ou l’établissement concerné par le projet d’accord portant rupture conventionnelle collective est établi. Si le projet d’accord portant rupture conventionnelle collective porte sur des établissements relevant de la compétence d’autorités différentes, l’autorité administrative compétente est désignée dans les conditions prévues par décret en Conseil d’Etat.
