Article L1243-4 of the French Public Health Code

Any organisation that ensures the conservation and preparation of tissues and cells, organs, blood, its components and derived products, derived from the human body with a view to their transfer for scientific use must hold an authorisation issued by the Minister responsible for research. Where the organisation is a health establishment, the authorisation is issued jointly by the Minister for Research and the Director General of the regional health agency with territorial jurisdiction.

By way of derogation, the activities provided for in the first paragraph carried out as part of research involving the human person are governed by Title II of Book I of Part One of this Code.

Tout organisme qui assure la conservation et la préparation de tissus et cellules, d’organes, de sang, de ses composants et de ses produits dérivés, issus du corps humain en vue de leur cession pour un usage scientifique doit être titulaire d’une autorisation délivrée par le ministre chargé de la recherche. Lorsque l’organisme est un établissement de santé, l’autorisation est délivrée de manière conjointe par le ministre chargé de la recherche et le directeur général de l’agence régionale de santé territorialement compétent.

Par dérogation, les activités prévues au premier alinéa exercées dans le cadre d’une recherche impliquant la personne humaine sont régies par le titre II du livre Ier de la première partie du présent code.
