Article L1251-19 of the French Labour Code

Temporary employees are entitled to an indemnity in lieu of paid leave for each assignment they carry out, regardless of its duration.

The amount of the allowance is calculated on the basis of the duration of the assignment and may not be less than one tenth of the total gross remuneration received by the employee during the assignment. The indemnity is paid at the end of the assignment.

For the purposes of assessing the employee’s rights, the following are treated as time spent on assignment:

1° periods of statutory maternity and adoption leave ;

2° Periods, limited to an uninterrupted period of one year, during which the assignment contract is suspended due to an accident at work or an occupational disease;

3° Periods during which an employee is called up for military service, provided that the starting point of these periods is during an assignment.

Le salarié temporaire a droit à une indemnité compensatrice de congé payé pour chaque mission qu’il effectue, quelle qu’en ait été la durée.

Le montant de l’indemnité est calculé en fonction de la durée de la mission et ne peut être inférieur au dixième de la rémunération totale brute perçue par le salarié pendant la mission. L’indemnité est versée à la fin de la mission.

Pour l’appréciation des droits du salarié, sont assimilées à un temps de mission :

1° Les périodes de congé légal de maternité et d’adoption ;

2° Les périodes, limitées à une durée ininterrompue d’un an, de suspension du contrat de mission pour cause d’accident du travail ou de maladie professionnelle ;

3° Les périodes pendant lesquelles un salarié est rappelé sous les drapeaux, à condition que le point de départ de ces périodes se place au cours d’une mission.
