Article L1311-2 of the French Public procurement code

Where a conceding authority decides to enter into a single contract intended to satisfy objectively separable needs which, on the one hand, are covered by the general law on concession contracts set out in Book I of Part Three and, on the other hand, are not covered by this Code, the contract shall be subject to this Book.
Where the subject of the contract is several activities, only one of which constitutes a network operator activity, it is subject to the provisions applicable to its main subject. Where the main purpose of the contract cannot be objectively determined, the contract is subject to the provisions of Book I of Part Three.

Lorsqu’une autorité concédante décide de conclure un contrat unique destiné à satisfaire des besoins, objectivement dissociables, qui, d’une part, relèvent du droit commun des contrats de concession prévu au livre Ier de la troisième partie et, d’autre part, ne relèvent pas du présent code, ce contrat est soumis à ce livre.
Lorsque ce contrat a pour objet plusieurs activités dont l’une seulement constitue une activité d’opérateur de réseau, il est soumis aux dispositions applicables à son objet principal. Lorsque l’objet principal du contrat ne peut être objectivement déterminé, le contrat est soumis aux dispositions du livre Ier de la troisième partie.
