Article L132-24-1 of the French Consumer Code

An administrative fine of up to €15,000 for a natural person and up to €75,000 for a legal person shall be imposed for failure to comply with the provisions of Regulation (EU) 2018/302 of the European Parliament and of the Council of 28 February 2018 on addressing unjustified geographic blocking and other forms of discrimination based on the nationality, residence or place of establishment of customers in the internal market and amending Regulations (EC) No 2006/2004 and (EU) 2017/2394 and Directive 2009/22/ EC, consisting of:

1° Blocking or restricting a customer’s access to an online interface or redirecting them without their consent to a different version of the interface that they initially wished to access, in breach of the prohibitions laid down in Article 3 of the same Regulation;

2° Applying general terms and conditions of access to goods and services in breach of Article 4 of the said Regulation;

3° Applying discriminatory terms of payment in breach of Article 5 of that Regulation;

This fine will be imposed in accordance with the conditions laid down in the Regulation.
This fine is imposed under the conditions laid down in Chapter II of Title II of Book V of this Code.

Article L132-24-1

Est passible d’une amende administrative, dont le montant ne peut excéder 15 000 euros pour une personne physique et 75 000 euros pour une personne morale, tout manquement aux dispositions du règlement (UE) 2018/302 du Parlement européen et du Conseil du 28 février 2018 visant à contrer le blocage géographique injustifié et d’autres formes de discrimination fondée sur la nationalité, le lieu de résidence ou le lieu d’établissement des clients dans le marché intérieur, et modifiant les règlements (CE) n° 2006/2004 et (UE) 2017/2394 et la directive 2009/22/ CE, constitué par le fait :

1° De bloquer ou de limiter l’accès d’un client à une interface en ligne ou de le rediriger sans son consentement vers une version différente de l’interface à laquelle il a initialement voulu accéder en violation des interdictions prévues à l’article 3 du même règlement ;

2° D’appliquer des conditions générales d’accès aux biens et aux services en méconnaissance de l’article 4 dudit règlement ;

3° D’appliquer des conditions de paiement discriminatoires en violation de l’article 5 du même règlement.

Cette amende est prononcée dans les conditions prévues au chapitre II du titre II du livre V du présent code.
