I.-Irrespective of criminal prosecution, in the event of non-compliance with the provisions of articles L. 1321-1, L. 1321-2, L. 1321-4, L. 1321-8, L. 1321-9, L. 1322-2, L. 1322-3 and L. 1322-4 or of the regulations and individual decisions taken for their application, the competent administrative authority gives formal notice to the person responsible for the production or distribution of water to the public or, failing this, to the owner of the production or distribution facility or of the spa establishment concerned to comply within a specified period.
II – If, on expiry of the time limit set, the interested party has not complied with this injunction, the competent administrative authority may :
1° Require the person concerned to deposit a sum corresponding to the estimated cost of the work to be carried out with a public accountant, which sum will be returned as and when the work is carried out; where applicable, this sum will be recovered in the same way as for State debts not relating to taxes or property;
2° Enforce the prescribed measures at the expense of the interested party. The sums deposited in application of the above provisions may be used to pay the expenses incurred by the compulsory enforcement;
3° Suspend, if necessary, production or distribution until the conditions imposed have been fulfilled;
4° Impose an administrative fine on the offender, together with a daily penalty.
