Article L1324-1 of the French Public Health Code

In addition to officers of the judicial police, the following are responsible for investigating and recording breaches of the provisions of Chapters I and II of this Title and of the regulations made for their application:

1° The agents mentioned in article L. 1312-1, authorised and sworn for this purpose ;

2° The agents mentioned in article L. 172-4 of the Environment Code, for offences relating to the protection perimeters provided for in articles L. 1321-2 and L. 1322-3 to L. 1322-7. However, the agents mentioned in II of article L. 161-4 of the Forestry Code may only record these offences.

Article L1324-1

Outre les officiers de police judiciaire, sont compétents pour rechercher et constater les infractions aux dispositions des chapitres Ier et II du présent titre ainsi qu’aux règlements pris pour leur application :

1° Les agents mentionnés à l’article L. 1312-1, habilités et assermentés à cet effet ;

2° Les agents mentionnés à l’article L. 172-4 du code de l’environnement, pour les infractions relatives aux périmètres de protection prévus aux articles L. 1321-2 et L. 1322-3 à L. 1322-7. Toutefois, les agents mentionnés au II de l’article L. 161-4 du code forestier, ne peuvent que constater ces infractions.
