I. – If the payer’s payment service provider is located in Saint-Pierre-et-Miquelon or Saint-Barthélemy and the payee’s payment service provider is located outside France, regardless of the currency used for the payment transaction, the following provisions apply :
a) The provisions of section 5 of this chapter ;
b) the provisions of section 6 of this chapter for unauthorised card payment transactions. In this case, by way of derogation from the second paragraph of I of Article L. 133-19, the payer shall bear, before the information provided for in Article L. 133-17, the losses relating to the use of the lost or stolen instrument up to a maximum of €50 in the event of an unauthorised payment transaction carried out without using personalised security data;
c) The provisions of the first paragraph of article L. 133-23 and article L. 133-24 for unauthorised card payment transactions. In this case, notwithstanding article L. 133-24, the thirteen-month period is reduced to seventy days. It may be extended contractually, but may not exceed one hundred and twenty days;
d) The provisions of II of article L. 133-26.
II. – The provisions of I also apply if the payer’s payment service provider is located in mainland France, the French overseas departments, the Department of Mayotte, Saint-Martin or Saint-Barthélemy and the payee’s payment service provider is located in a country that is not a member of the European Union or a party to the European Economic Area agreement, regardless of the currency used for the payment transaction.
