Article L133-19 of the French Tourism Code

The rules relating to the upgrading to a higher demographic category of municipalities classified as tourist resorts within the meaning of sub-section 2 of section 2 of this chapter are set out in the penultimate paragraph of article 88 of law no. 84-53 of 26th January 1984 on statutory provisions relating to the local civil service.

A municipality that loses the benefit of classification as a tourist resort shall bring its jobs into line with the demographic category to which it belongs by reference to its total population according to the latest census, at the rate of job vacancies recorded in the municipality and without this change in demographic category affecting the statutory and regulatory situation of active employees.

Les règles relatives au surclassement dans une catégorie démographique supérieure des communes classées stations de tourisme au sens de la sous-section 2 de la section 2 du présent chapitre sont fixées à l’avant-dernier alinéa de l’article 88 de la loi n° 84-53 du 26 janvier 1984 portant dispositions statutaires relatives à la fonction publique territoriale.

La commune qui perd le bénéfice du classement en station de tourisme conforme ses emplois à la catégorie démographique à laquelle elle appartient par référence à sa population totale issue du dernier recensement, au rythme des vacances d’emploi constatées dans la commune et sans que ce changement de catégorie démographique porte atteinte à la situation statutaire et réglementaire des agents en activité.
