I. – Provided that the payment account is accessible online, the payer may contact a payment service provider of his choice to obtain the payment initiation service referred to in 7° of II of Article L. 314-1.
Where the payer gives his explicit consent to the execution of a payment in accordance with Article L. 133-6, the payment service provider managing the account shall carry out the actions provided for in III.
II. – When providing the payment initiation service referred to in 7° of II of Article L. 314-1, the payment service provider :
1° shall at no time hold the payer’s funds that were the subject of the payment transaction initiated by the payment service provider providing the payment initiation service ;
2° Shall ensure that the payment service user’s personalised security data is not accessible to parties other than the payment service user and the issuer of the data, and shall ensure that the data is transmitted via secure and efficient channels;
3° Ensure that any other information relating to the payment service user obtained in the course of providing payment initiation services is disclosed only to the payee and only with the payment service user’s express consent;
4° Identifies itself to the payment service provider managing the payer’s account each time a payment is initiated and communicates under the conditions set out in the delegated act adopted pursuant to Article 98.1 of Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 on payment services in the internal market with the payment service provider managing the account, the payer and the payee ;
5° Does not store sensitive payment data relating to the payment service user ;
6° Does not ask the payment service user for data other than that required to provide the payment initiation service;
7° Does not use, consult or store data for purposes other than providing the payment initiation service expressly requested by the payer;
8° Does not modify the amount, the beneficiary or any other characteristic of the transaction.
III. – When a payment service user uses a payment initiation service, his payment service provider managing the account :
1° Communicates under the conditions set out in the delegated act adopted pursuant to Article 98.1 of the aforementioned Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 with the payment service provider providing the payment initiation service ;
2° Provides the payment service provider providing the payment initiation service, or makes available to it, immediately after receipt of a payment order, all information on the initiation of the payment transaction and all information to which it itself has access concerning the execution of the payment transaction ;
3° Processes payment orders transmitted by the service provider providing the payment initiation service without any discrimination other than based on objective reasons, in terms of time, priority or costs compared with payment orders transmitted directly by the payer.
IV. – The provision of payment initiation services shall not be conditional on the existence of a contractual relationship between the payment service providers providing the payment initiation service and the payment service providers managing the accounts.
