Article L1334-16-2 of the French Public Health Code

If the population is exposed to asbestos fibres as a result of human activity, the representative of the State in the département may, in the event of a serious health hazard, order the implementation of measures to assess and stop the exposure, within a timeframe set by the representative of the State. If the person responsible for the emitting activity fails to do so, the representative of the State in the département will proceed automatically at the latter’s expense.

The public debt is recovered in the same way as for direct taxation.

Si la population est exposée à des fibres d’amiante résultant d’une activité humaine, le représentant de l’Etat dans le département peut, en cas de danger grave pour la santé, ordonner, dans des délais qu’il fixe, la mise en œuvre des mesures propres à évaluer et à faire cesser l’exposition. Faute d’exécution par la personne responsable de l’activité émettrice, le représentant de l’Etat dans le département y procède d’office aux frais de celle-ci.



La créance publique est recouvrée comme en matière de contributions directes.
