Article L1335-5 of the French Public Health Code

The procedures for applying articles L. 1335-3 and L. 1335-4 are determined by decree by the Conseil d’Etat, in particular:

1° The hygiene and design rules with which the facilities referred to in article L. 1335-3 must comply;

2° The inspection and monitoring procedures, the conditions under which the use of the facilities mentioned in article L. 1335-4 is prohibited, and the conditions under which the operator of these facilities is responsible for inspection costs.

Article L1335-5

Sont déterminées par décret en Conseil d’Etat les modalités d’application des articles L. 1335-3 et L. 1335-4, notamment :

1° Les règles d’hygiène et de conception auxquelles doivent se conformer les installations mentionnées à l’article L. 1335-3 ;

2° Les modalités de contrôle et de surveillance, les conditions d’interdiction d’utilisation des installations mentionnées à l’article L. 1335-4, ainsi que les conditions dans lesquelles les dépenses de contrôle sont mises à la charge de l’exploitant de ces installations.
