Article L1337-1 A of the French Public Health Code

In the event of non-compliance with articles L. 1332-1 to L. 1332-4 and articles L. 1332-6 to L. 1332-9, the administrative authority shall give formal notice to the operator or, failing this, the owner to comply within a specified period. It may order any necessary inspections, expert reports or analyses, the costs being borne by the operator or owner.

If the interested party has not complied with this injunction by the end of the specified period, the administrative authority may:

1° Require the interested party to deposit a sum corresponding to the estimated cost of the work to be carried out with a public accountant, which sum will be returned as and when the work is carried out. If the work is not carried out before the deadline set by the administrative authority, the sum deposited is definitively forfeited to the State in order to pay for the expenses incurred in carrying out the work on behalf of the person concerned. It will be recovered in the same way as for State debts other than taxes and property;

2° Have the measures prescribed carried out automatically, in place of the operator or, failing this, the owner and at the latter’s expense;

3° Suspend, if necessary, the operation of the installations or works, or the carrying out of activities until the conditions imposed have been fulfilled.

Article L1337-1 A

En cas d’inobservation des articles L. 1332-1 à L. 1332-4 et des articles L. 1332-6 à L. 1332-9, l’autorité administrative met en demeure l’exploitant ou, à défaut, le propriétaire d’y satisfaire dans un délai déterminé. Elle peut prescrire tous contrôles, expertises ou analyses nécessaires, les dépenses étant à la charge de l’exploitant ou du propriétaire.

Si, à l’expiration du délai fixé, l’intéressé n’a pas obtempéré à cette injonction, l’autorité administrative peut :

1° L’obliger à consigner, entre les mains d’un comptable public, une somme correspondant à l’estimation du montant des travaux à réaliser, laquelle est restituée au fur et à mesure de leur exécution. A défaut de réalisation des travaux avant l’échéance fixée par l’autorité administrative, la somme consignée est définitivement acquise à l’Etat afin de régler les dépenses entraînées par l’exécution des travaux en lieu et place de l’intéressé. Il est procédé à son recouvrement comme en matière de créances de l’Etat étrangères à l’impôt et au domaine ;

2° Faire procéder d’office, en lieu et place de l’exploitant ou, à défaut, du propriétaire et à ses frais, à l’exécution des mesures prescrites ;

3° Suspendre, s’il y a lieu, l’exploitation des installations ou des ouvrages, l’exercice des activités jusqu’à exécution des conditions imposées.
