Article L1337-9 of the French Public Health Code

The provisions of articles L. 173-5 to L. 173-12 of the Environment Code apply to offences under this chapter.

Corporate entities declared criminally liable, under the conditions provided for by’article 121-2 of the Criminal Code, for the offences defined in article L. 1337-8 are liable, in addition to a fine in accordance with article 131-38 of the French Penal Code, to a ban on the sale of the product advertised in breach of article L. 1337-8.

Les dispositions des articles L. 173-5 à L. 173-12 du code de l’environnement s’appliquent aux infractions prévues par le présent chapitre.

Les personnes morales déclarées responsables pénalement, dans les conditions prévues par l’article 121-2 du code pénal, des infractions définies à l’article L. 1337-8 encourent, outre l’amende suivant les modalités prévues par l’article 131-38 du code pénal, la peine d’interdiction de vente du produit dont la publicité a été faite en violation de l’article L. 1337-8.
