Article L1338-3 of the French Public Health Code

Any distributor or seller of plants likely to be harmful to human health is required to inform the purchaser, prior to the conclusion of the sale, of the risks to human health and, where appropriate, of the means of protecting against them. An order of the ministers responsible for health and consumer affairs, issued after consultation with the Haut Conseil de la santé publique (High Council for Public Health) and the Conseil national de la consommation (National Consumer Affairs Council), sets the list of plants covered by these provisions and determines, for each of them, the nature of this information and the content and format of the information that must appear on the documents accompanying the plants concerned.

Tout distributeur ou vendeur de végétaux susceptibles de porter atteinte à la santé humaine est tenu d’informer, préalablement à la conclusion de la vente, l’acquéreur des risques pour la santé humaine et, le cas échéant, des moyens de s’en prémunir. Un arrêté des ministres chargés de la santé et de la consommation, pris après avis du Haut Conseil de la santé publique et du Conseil national de la consommation, fixe la liste des végétaux concernés par ces dispositions et détermine, pour chacun d’eux, la nature de ces informations, le contenu et le format des mentions devant figurer sur les documents d’accompagnement des végétaux concernés.
