The Commission referred to in the eighth paragraph of Article L. 141-2 examines applications for registration from the persons referred to in Articles L. 211-1 to L. 211-6 and, after checking that they have complied with the obligations imposed on them, registers them in a register of travel agents and other operators selling travel and holidays.
The commission is made up of members appointed for their competence and independence by order of the Minister responsible for tourism. It may not include economic operators whose activity is subject to registration in this register.
All members of the Commission must inform the Chairman of any interests they hold or any positions they hold in any economic activity.
No member of the Commission may deliberate on a matter in which he has a direct personal interest or if he represents or has represented one of the interested parties.
Registration is renewable every three years.
A decree of the Conseil d’Etat shall lay down the conditions for the application of this article. In particular, it shall specify the conditions for registration and deletion from the register. It shall determine the information that must be made public, as well as that which is freely accessible to the public by electronic means. It specifies the guarantees of independence and impartiality of the members of the committee responsible for registering, in particular those of its chairman, as well as the duration of their term of office and determines the procedures for maintaining the register under objective, transparent and non-discriminatory conditions.
