Article L141-5 of the French Sports Code

I.-The French National Olympic and Sports Committee is the owner of the national Olympic emblems.

It is also the depositary of :

1° The Olympic emblems, flag, motto and symbol ;

2° The Olympic anthem;

3° The logo, mascot, slogan and posters of the Olympic Games;

4° The year of the Olympic Games “city + year”, in conjunction with the French Paralympic and Sports Committee;

5° The terms “Olympic Games”, “Olympism” and “Olympiad” and the acronym “JO”;

6° The terms “Olympic”, “Olympian” and “Olympienne”, except in common parlance for normal use excluding any use of any of them for promotional or commercial purposes or any risk of causing confusion in the mind of the public with the Olympic movement.

II -The act of registering as a trademark, reproducing, imitating, affixing, deleting or modifying the elements and terms mentioned in I or their translations, without the authorisation of the French National Olympic and Sports Committee, is punishable by the penalties set out in Articles L. 716-9 to L. 716-13 of the Intellectual Property Code.

III – By way of exception to II and for acts committed between 1 January 2019 and 31 December 2024, the rights and actions arising from this article shall be exercised by the Organising Committee of the Olympic and Paralympic Games on its own behalf. However, the French National Olympic and Sports Committee may join any proceedings or body in order to obtain compensation for the damage it has suffered.

Article L141-5

I.-Le Comité national olympique et sportif français est propriétaire des emblèmes olympiques nationaux.

Il est également dépositaire :

1° Des emblèmes, du drapeau, de la devise et du symbole olympiques ;

2° De l’hymne olympique ;

3° Du logo, de la mascotte, du slogan et des affiches des jeux Olympiques ;

4° Du millésime des éditions des jeux Olympiques “ ville + année ”, de manière conjointe avec le Comité paralympique et sportif français ;

5° Des termes “ jeux Olympiques ”, “ olympisme ” et “ olympiade ” et du sigle “ JO ” ;

6° Des termes “ olympique ”, “ olympien ” et “ olympienne ”, sauf dans le langage commun pour un usage normal excluant toute utilisation de l’un d’entre eux à titre promotionnel ou commercial ou tout risque d’entraîner une confusion dans l’esprit du public avec le mouvement olympique.

II.-Le fait de déposer à titre de marque, de reproduire, d’imiter, d’apposer, de supprimer ou de modifier les éléments et les termes mentionnés au I ou leurs traductions, sans l’autorisation du Comité national olympique et sportif français, est puni des peines prévues aux articles L. 716-9 à L. 716-13 du code de la propriété intellectuelle.

III.-Par exception au II et pour les faits commis entre le 1er janvier 2019 et le 31 décembre 2024, les droits et actions découlant du présent article sont exercés par le comité d’organisation des jeux olympiques et paralympiques pour son propre compte. Toutefois, le Comité national olympique et sportif français peut se joindre à toute procédure ou instance afin d’obtenir la réparation du préjudice qui lui est propre.
