I.-The Agency is administered by a Board of Directors, made up of the following members in addition to its Chairman, appointed by decree:
1° Representatives of :
a) The State ;
b) Compulsory health insurance schemes ;
c) Institutional partners of the Agency ;
d) Health professionals ;
e) Associations of users of the healthcare system approved in application of article L. 1114-1, approved associations active in the field of consumer protection, family protection, environmental protection and the defence of victims of accidents at work and occupational diseases;
1° bis Two Members of Parliament and two Senators;
2° Elected representatives of local and regional authorities;
3° Qualified persons chosen for their expertise in the areas covered by the Agency’s missions;
4° Staff representatives.
In the event of a tie, the Chairman has the casting vote.
The Board of Directors sets the guidelines for the Agency’s policy. It shall also deliberate on the rules of professional conduct referred to in Article L. 1413-12-2 and on subjects defined by regulation.
II – The Board of Directors sits in a restricted formation, when confidentiality is required by its Chairman or by the Minister for Health in order to protect national defence secrets, civil security secrets or business secrets, for deliberations relating to the mission provided for in 5° of article L. 1413-1 and in the eleventh paragraph of the same article. In restricted formation, the Board of Directors is composed of its Chairman, representatives of the State and of the compulsory health insurance schemes.
