Article L142-3 of the French Civil Aviation Code

In the event of the disappearance of an aircraft without any news, the aircraft is deemed to have been lost three months after the date on which the last news was sent.

The death of the persons on board the aircraft may, after expiry of this period, be declared by judgment in application of articles 87 to 89 of the Civil Code.

It is the responsibility of the Minister in charge of civil aviation to declare, where appropriate, the presumption of disappearance and to address to the public prosecutor at the competent court of appeal the necessary requisitions for the judicial declaration of the death of missing persons.

Interested parties may also apply, in accordance with article 90 of the Civil Code, for a judicial declaration of death. In this case, the application is forwarded by the Public Prosecutor to the Minister responsible for civil aviation.

Au cas de disparition sans nouvelles d’un aéronef, l’appareil est réputé perdu trois mois après la date de l’envoi des dernières nouvelles.

Le décès des personnes se trouvant à bord de l’aéronef peut, après expiration de ce délai, être déclaré par jugement par application des articles 87 à 89 du code civil.

Il appartient au ministre chargé de l’aviation civile de déclarer, le cas échéant, la présomption de disparition et d’adresser au procureur général près la cour d’appel compétente les réquisitions nécessaires pour la constatation judiciaire des décès des personnes disparues.

Les intéressés peuvent également se pourvoir, conformément à l’article 90 du code civil, à l’effet d’obtenir la déclaration judiciaire d’un décès. La requête, en ce cas, est communiquée par le ministère public au ministre chargé de l’aviation civile.
