Article L1441-6 of the French Public Health Code

I.-For the application of article L. 1431-2 in Saint-Pierre-et-Miquelon:

1° In b of 1°, the words: “in accordance with the remit of the representative of the State with territorial jurisdiction,” are deleted;

2° In c of 1°, the words “and the priorities defined by the representative of the State with territorial jurisdiction” are deleted;

3° The first sentence of g of 2° is worded as follows: “The territorial health administration defines and implements, with the social welfare fund and the Caisse nationale de solidarité pour l’autonomie, actions specific to Saint-Pierre-et-Miquelon that extend, adapt and supplement national risk management programmes and complementary actions”.

II – For the application of article L. 1434-10 to Saint-Pierre-et-Miquelon, the second sentence of the second paragraph of I is worded as follows: “This council shall ensure that the specific nature of local health systems and approaches based on the participation of local residents is preserved. “

III-(Repealed)

IV.-For the application of the second paragraph of article L. 1434-17 in Saint-Pierre-et-Miquelon, the words: “territorial health projects” are replaced by the words: “local health projects”.

V.-For the application of the first paragraph of Article L. 1435-1 in Saint-Pierre-et-Miquelon, the words: “the representative of the State with territorial jurisdiction as well as” are deleted.

VI.-For the application of article L. 1435-5 in Saint-Pierre-et-Miquelon, the second sentence of the first paragraph is worded as follows: “Its procedures are drawn up in association with the representatives of health professionals, including the Ordre des Médecins or the body responsible for its missions. “

VII – For the application of the penultimate paragraph of Article L. 1435-7 in Saint-Pierre-et-Miquelon, the words: “to the representative of the State with territorial jurisdiction as well as” are deleted.

Article L1441-6

I.-Pour l’application à Saint-Pierre-et-Miquelon de l’article L. 1431-2 :

1° Au b du 1°, les mots : ” dans le respect des attributions du représentant de l’Etat territorialement compétent, ” sont supprimés ;

2° Au c du 1°, les mots : ” et des priorités définies par le représentant de l’Etat territorialement compétent ” sont supprimés ;

3° La première phrase du g du 2° est ainsi rédigée : ” L’administration territoriale de santé définit et met en œuvre, avec la caisse de prévoyance sociale et avec la Caisse nationale de solidarité pour l’autonomie, les actions propres à Saint-Pierre-et-Miquelon prolongeant, adaptant et complétant les programmes nationaux de gestion du risque et des actions complémentaires ”.

II.-Pour l’application à Saint-Pierre-et-Miquelon de l’article L. 1434-10, la deuxième phrase du deuxième alinéa du I est ainsi rédigée : “ Ce conseil veille à conserver la spécificité des dispositifs et des démarches locales de santé fondés sur la participation des habitants. ”

III.-(Abrogé)

IV.-Pour l’application du deuxième alinéa de l’article L. 1434-17 à Saint-Pierre-et-Miquelon, les mots : ” projets territoriaux sanitaires ” sont remplacés par les mots : ” projets sanitaires locaux “.

V.-Pour l’application du premier alinéa de l’article L. 1435-1 à Saint-Pierre-et-Miquelon, les mots : ” le représentant de l’Etat territorialement compétent ainsi que ” sont supprimés.

VI.-Pour l’application de l’article L. 1435-5 à Saint-Pierre-et-Miquelon, la deuxième phrase du premier alinéa est ainsi rédigée : ” Ses modalités sont élaborées en association avec les représentants des professionnels de santé, dont l’ordre des médecins ou l’organisme qui en assure les missions. “

VII.-Pour l’application de l’avant-dernier alinéa de l’article L. 1435-7 à Saint-Pierre-et-Miquelon, les mots : ” au représentant de l’Etat territorialement compétent ainsi qu'” sont supprimés.
