Article L1454-1-2 of the French Labour Code

The conciliation and referral office prepares cases for trial.

If the case is not ready for trial before the Judgement Office, the latter may prepare the case for trial.

One or two reporting councillors may be appointed to prepare the case for trial. They shall prescribe all measures necessary for this purpose.

The inspection officers referred to in Article L. 8271-1-2 shall provide the reporting advisors, at the latter’s request and without being able to invoke professional secrecy, with any information and documents relating to concealed work, bargaining or the illegal loan of labour that are in their possession.

The Conciliation and Referral Office, the Reporting Advisors appointed by the Conciliation and Referral Office or the Judgement Office may set the end of the investigation by order, a copy of which is given to the parties or their counsel. This order constitutes a measure of judicial administration.

Le bureau de conciliation et d’orientation assure la mise en état des affaires.

Lorsque l’affaire n’est pas en état d’être jugée devant le bureau de jugement, celui-ci peut assurer sa mise en état.

Un ou deux conseillers rapporteurs peuvent être désignés pour que l’affaire soit mise en état d’être jugée. Ils prescrivent toutes mesures nécessaires à cet effet.

Les agents de contrôle mentionnés à l’article L. 8271-1-2 communiquent aux conseillers rapporteurs, à la demande de ceux-ci et sans pouvoir opposer le secret professionnel, les renseignements et documents relatifs au travail dissimulé, au marchandage ou au prêt illicite de main-d’œuvre dont ils disposent.

Le bureau de conciliation et d’orientation, les conseillers rapporteurs désignés par le bureau de conciliation et d’orientation ou le bureau de jugement peuvent fixer la clôture de l’instruction par ordonnance, dont copie est remise aux parties ou à leur conseil. Cette ordonnance constitue une mesure d’administration judiciaire.
