Article L171-5 of the French Insurance Code

This Title does not apply to insurance contracts intended to cover risks relating to pleasure boating.

Such contracts are subject to the provisions of Titles I, II and III of this Book. However, the provisions of article L. 124-3 do not prevent the application of the rules concerning the allocation of the insurance indemnity to the constitution of the limitation fund as set out in articles L. 173-23 and L. 173-24.

Air and aviation insurance policies taken out by persons not engaged in a commercial or profit-making activity are subject to the provisions of Titles I, II and III of this Book.

Air and aviation insurance policies taken out by persons carrying on a commercial or profit-making activity using only light aircraft may, at their option, be subject to the provisions of Titles I, II and III of this Book.

Article L. 175-10 applies to all aviation and aeronautical insurance contracts.

The terms of application of this article shall be specified by decree.

Le présent titre n’est pas applicable aux contrats d’assurance ayant pour objet de garantir les risques relatifs à la navigation de plaisance.

Ces contrats sont soumis aux dispositions des titres Ier, II et III du présent livre. Toutefois, les dispositions de l’article L. 124-3 ne font pas obstacle à l’application des règles concernant l’affectation de l’indemnité d’assurance à la constitution du fonds de limitation telles qu’elles sont prévues par les articles L. 173-23 et L. 173-24.

Les contrats d’assurance aérienne et aéronautique souscrits par des personnes n’exerçant pas une activité commerciale ou à but lucratif sont soumis aux dispositions des titres Ier, II et III du présent livre.

Les contrats d’assurance aérienne et aéronautique souscrits par des personnes exerçant une activité commerciale ou à but lucratif au moyen exclusif d’aéronefs légers peuvent, sur option, être soumis aux dispositions des titres Ier, II et III du présent livre.

L’article L. 175-10 est applicable à tout contrat d’assurance aérienne et aéronautique.

Les modalités d’application du présent article sont précisées par décret.
