Article L176-4 of the French Insurance Code

The insured must pay the premium and costs at the agreed place and time.

Failure to pay all or part of the premium by the due date entitles the insurer either to suspend cover or to request cancellation.

Suspension or cancellation does not take effect until thirty days after the insured has been served with formal notice to pay by registered letter to his last address known to the insurer.

In the case of fixed-term insurance, the premium due on the effective date of the insurance contract may be paid in instalments. However, if the amount of a covered loss exceeds the fractional premiums already paid, the insurer may demand immediate payment of the balance of the premium.

In the event of fraud by the insured, the premium remains the property of the insurer.

L’assuré doit payer la prime et les frais, au lieu et aux époques convenus.


Le défaut de paiement de tout ou partie de la prime, à sa date d’exigibilité, permet à l’assureur soit de suspendre les garanties, soit d’en demander la résiliation.


La suspension ou la résiliation ne prend effet que trente jours après la notification par lettre recommandée à l’assuré, à son dernier domicile connu de l’assureur, d’une mise en demeure d’avoir à payer.


Dans l’assurance à durée déterminée, la prime due à la date d’effet du contrat d’assurance pourra être fractionnée. Cependant, dans le cas où le montant d’un sinistre garanti est supérieur aux fractions de primes déjà réglées, l’assureur pourra exiger le paiement immédiat du solde de la prime.


En cas de fraude de l’assuré, la prime demeure acquise à l’assureur.
