Article L211-12 of the French Insurance Code

When, due to the victim’s fault, the third-party payers have been unable to assert their rights against the insurer, they have a right of recourse against the victim up to the amount of the compensation that the victim has received from the insurer for the same head of loss and within the limits provided for in article 31 of law no. 85-677 of 5 July 1985. They must take action within two years of the claim for payment of benefits.

Article L211-12

Lorsque, du fait de la victime, les tiers payeurs n’ont pu faire valoir leurs droits contre l’assureur, ils ont un recours contre la victime à concurrence de l’indemnité qu’elle a perçue de l’assureur au titre du même chef de préjudice et dans les limites prévues à l’article 31 de la loi n° 85-677 du 5 juillet 1985. Ils doivent agir dans un délai de deux ans à compter de la demande de versement des prestations.
