Article L211-5-1 of the French Tourism Code

A declaration by an organiser of a tourist package or by a professional facilitating a tied travel service that he is acting exclusively in his capacity as provider of a travel service, as an intermediary or in any other capacity, or that a package or a tied travel service does not constitute a package or a tied travel service, does not release that organiser or professional from the obligations imposed on him by this chapter.

Contractual provisions or declarations made by the traveller which, directly or indirectly, constitute a waiver of the rights conferred on travellers or a restriction of these rights, or which are intended to avoid the application of this chapter, are not enforceable against the traveller.

Article L211-5-1

La déclaration d’un organisateur de forfait touristique ou d’un professionnel facilitant une prestation de voyage liée mentionnant qu’il agit exclusivement en qualité de prestataire d’un service de voyage, d’intermédiaire ou en toute autre qualité, ou qu’un forfait ou une prestation de voyage liée ne constitue pas un forfait ou une prestation de voyage liée, ne libère pas ledit organisateur ou professionnel des obligations qui lui sont imposées par le présent chapitre.

Les dispositions contractuelles ou les déclarations faites par le voyageur qui, directement ou indirectement, constituent une renonciation aux droits conférés aux voyageurs ou une restriction de ces droits, ou qui visent à éviter l’application de ce chapitre ne sont pas opposables au voyageur.
