For the application of article L. 2111-2, the departmental services in charge of maternal and child protection may, in the event of a presumption that the childminder is taking in more children than authorised by the authorisation provided for in article L. 421-4 of the Code de l’action sociale et des familles, request the information necessary for them to carry out their duties from the body responsible for collecting social security contributions mentioned in article L. 531-8 of the Code de la sécurité sociale, which is required to provide this information.
The body responsible for collecting the social security contributions referred to in article L. 531-8 of the Social Security Code will also pass on to the departmental services responsible for maternal and child protection any useful information when it becomes aware of information or facts that may reveal the existence of fraud in the practice of the profession of childminder.
The procedures for transmitting this information are specified by order of the Minister responsible for social security.
