I.-Only holders of a diploma, professional qualification or certificate of professional qualification may, for remuneration, teach, lead or supervise a physical or sporting activity or train its participants, as their main or secondary occupation, on a regular, seasonal or occasional basis, subject to the provisions of the fourth paragraph of this article and of article L. 212-2 of this code:
1° Guaranteeing the holder’s competence in terms of the safety of participants and third parties in the activity in question ;
2° And registered in the National Register of Professional Certifications under the conditions laid down in Article L. 6113-5 of the Labour Code.
The functions mentioned in the first paragraph above may also be exercised for remuneration by persons undergoing training to prepare for a diploma, professional qualification or certificate of professional qualification that complies with the requirements of 1° and 2° above, under the conditions laid down by the regulations for this diploma, qualification or certificate.
II-The diploma referred to in I may be a foreign diploma accepted as equivalent.
III-The provisions of I apply as soon as the diplomas, evidence of formal qualifications or certificates of professional qualification are entered on the list of diplomas, evidence of formal qualifications or certificates of professional qualification that meet the conditions laid down in paragraphs I and II, as and when they are entered on the list.
IV-Persons who, in the period preceding the registration referred to in III and in accordance with the legislative provisions in force, have acquired the right to perform for remuneration one of the functions referred to in I shall retain this right.
V.-A Conseil d’Etat decree sets out the conditions for the application of this article. In particular, it lays down the procedures for drawing up the list referred to in III.
