Chapter II: Teaching sport for remuneration

I.-Only holders of a diploma, professional qualification or certificate of professional qualification may, for remuneration, teach, lead or supervise a physical or sporting activity or train its participants, as their main or secondary occupation, on a regular, seasonal or occasional basis, subject to the provisions of the fourth paragraph of this article and of article L. 212-2 of this code: 1° Guaranteeing the holder’s competence in terms of the safety…

This section and section 3 of this chapter do not apply to persons who perform the duties mentioned in article L. 212-1 for foreign sports delegations and teams at sporting events mentioned in article L. 230-2. This derogation is limited to the supervision of members of the teams and delegations taking part in these events, for the duration of the event.

When the activity mentioned in the first paragraph of article L. 212-1 is practised in a specific environment requiring compliance with special safety measures, it can only be practised with the possession of a diploma. The provisions of articles L. 212-1 and L. 212-2 do not apply to military personnel, to civil servants covered by titles II, III and IV of the general status of civil servants in the performance of their duties under their special status, or to teachers in public educational establishments and private educational establishments under contract with the State in the performance of their duties.

The provision of equipment for participants or, except in the case of activities taking place in a specific environment, the facilitation of the practice of the activity within a classified establishment subject to tourism regulations cannot be assimilated to the functions designated in the first paragraph of article L. 212-1.

In martial arts sports, no one may claim a dan or equivalent grade that recognises sporting qualities, technical knowledge and, where applicable, competitive performance unless it has been awarded by the specialised commission for dan and equivalent grades of the delegating federation or, failing that, the approved federation devoted exclusively to martial arts. An order by the Minister for Sport sets the list of federations mentioned in the first paragraph.

The specialised commissions for equivalent degrees and grades, whose composition is set by order of the Minister for Sport after consultation with the federations concerned, submit the conditions for awarding these degrees and grades to the Minister for Sport, who approves them by order.

The duties mentioned in the first paragraph of article L. 212-1 may be performed on national territory by nationals of Member States of the European Union or States party to the Agreement on the European Economic Area, who are qualified to perform them in one of these States.
