Article L212-8 of the French Sports Code

Any person shall be liable to one year’s imprisonment and a fine of 15,000 euros if he or she:

1° Exercising for remuneration one of the functions of teacher, instructor, educator, trainer or leader of a physical or sporting activity or using these titles or any other similar title without possessing the qualification required in I of article L. 212-1 or exercising his or her activity in breach of article L. 212-7 without having passed the tests to which the administrative authority has subjected him or her ;

2° Employing a person who performs the functions mentioned in the first paragraph of article L. 212-1 without holding the required qualification or employing a national of a Member State of the European Community or of a State party to the Agreement on the European Economic Area who performs his activity in breach of article L. 212-7 without having passed the tests to which the administrative authority has subjected him.

Article L212-8

Est puni d’un an d’emprisonnement et de 15 000 euros d’amende le fait pour toute personne :

1° D’exercer contre rémunération l’une des fonctions de professeur, moniteur, éducateur, entraîneur ou animateur d’une activité physique ou sportive ou de faire usage de ces titres ou de tout autre titre similaire sans posséder la qualification requise au I de l’article L. 212-1 ou d’exercer son activité en violation de l’article L. 212-7 sans avoir satisfait aux tests auxquels l’autorité administrative l’a soumise ;

2° D’employer une personne qui exerce les fonctions mentionnées au premier alinéa de l’article L. 212-1 sans posséder la qualification requise ou d’employer un ressortissant d’un Etat membre de la Communauté européenne ou d’un Etat partie à l’accord sur l’Espace économique européen qui exerce son activité en violation de l’article L. 212-7 sans avoir satisfait aux tests auxquels l’autorité administrative l’a soumis.
