Article L212-10-3 of the French Cinema and Moving Image Code

At the initiative of the representative of the State in the department, the mayor of the municipality in which the site is located, the president of the public inter-municipal cooperation establishment mentioned in b of 1° of II of article L. 212-6-2, of the person mentioned in e of the same 1° or of the president of the mixed syndicate mentioned in the same e and of any person with an interest in acting, the decision of the departmental cinematographic development commission may, within a period of one month, be appealed to the National Cinematographic Development Commission. The Commission nationale d’aménagement cinématographique gives its decision within four months of the date of referral.

A referral to the Commission nationale d’aménagement cinématographique is a mandatory prerequisite to a contentious appeal, failing which the latter will be inadmissible.

This appeal is also open to the cinema ombudsman.

A l’initiative du représentant de l’Etat dans le département, du maire de la commune d’implantation, du président de l’établissement public de coopération intercommunale mentionné au b du 1° du II de l’article L. 212-6-2, de celui mentionné au e du même 1° ou du président du syndicat mixte mentionné au même e et de toute personne ayant intérêt à agir, la décision de la commission départementale d’aménagement cinématographique peut, dans un délai d’un mois, faire l’objet d’un recours devant la Commission nationale d’aménagement cinématographique. La Commission nationale d’aménagement cinématographique se prononce dans un délai de quatre mois à compter de sa saisine.

La saisine de la Commission nationale d’aménagement cinématographique est un préalable obligatoire à un recours contentieux, à peine d’irrecevabilité de ce dernier.

Ce recours est également ouvert au médiateur du cinéma.
