Article L212-28 of the French Cinema and Moving Image Code

In order to grant the authorisation provided for in article L. 212-27, the President of the Centre national du cinéma et de l’image animée must ensure, on the basis of measurable economic data, in particular that provided by the exhibitor with its application, that a reference price per seat is set, taking into account changes in the average price of single tickets sold by the exhibitor, the situation of the exhibition market and the observed and expected effects of the access formula.

The reference price serves as the basis for the remuneration of rights holders.

The rate of participation proportional to revenue is identical to the rate agreed for single ticket sales.

The content and minimum duration of the operator’s commitments will be specified in a decree issued by the Conseil d’Etat after obtaining the opinion of the Autorité de la concurrence.

Pour accorder l’agrément prévu à l’article L. 212-27, le président du Centre national du cinéma et de l’image animée doit s’assurer, à partir de données économiques mesurables, notamment de celles que l’exploitant joint à sa demande, qu’un prix de référence par place est fixé en tenant compte de l’évolution du prix moyen des entrées vendues à l’unité par l’exploitant, de la situation du marché de l’exploitation et des effets constatés et attendus de la formule d’accès.

Le prix de référence sert d’assiette à la rémunération des ayants droit.

Le taux de participation proportionnelle aux recettes est identique au taux convenu pour les entrées vendues à l’unité.

Un décret en Conseil d’Etat pris après avis de l’Autorité de la concurrence précise le contenu et la durée minimale des engagements de l’exploitant.
