I.-The Departmental Cinematographic Development Commission is chaired by the representative of the State in the Department.
II -The commission is made up of :
1° The following five elected representatives:
a) The mayor of the municipality in which the cinema development project is located ;
b) The president of the public establishment for inter-communal cooperation with responsibility for spatial planning and development, of which the municipality in which the project is to be set up is a member, or, failing this, the general councillor for the canton in which the project is to be set up or, in Corsica, a councillor to the Assembly of Corsica elected from among its members;
c) The mayor of the most populous commune in the arrondissement, other than the commune in which the facility is located; with the exception of municipalities in the Hauts-de-Seine, Seine-Saint-Denis and Val-de-Marne départements and municipalities in Essonne, Val-d’Oise, Yvelines and Seine-et-Marne belonging to the Paris conurbation as defined by the National Institute for Statistics and Economic Studies, where the municipality in which the Council is located belongs to a conurbation comprising at least five municipalities, the mayor of the most populous municipality is chosen from among the mayors of the municipalities in the said conurbation;
d) The President of the General Council or his/her representative, or, in Corsica, the President of the Executive Council or his/her representative;
e) The president of the syndicat mixte or of the établissement public de coopération intercommunale responsible for the schéma de cohérence territoriale (territorial coherence plan) to which the municipality in which the facility is to be located belongs or his/her representative or, failing this, a deputy mayor of the municipality in which the facility is to be located.
If one of the elected representatives holds more than one of the mandates mentioned in this 1°, the State representative in the department appoints one or more mayors of towns located in the cinematographic influence zone concerned to replace him/her;
2° Three people qualified in film distribution and exhibition, sustainable development and regional planning.
When the area of cinematographic influence of the project extends beyond the boundaries of the département, the representative of the State in the département completes the composition of the commission by appointing at least one elected representative and one qualified personality from each of the other départements concerned.
The commission hears any person likely to be able to enlighten its decision.
III – In Paris, the commission is made up of :
1° The following five elected representatives:
a) The Mayor of Paris or his representative ;
b) The mayor of the arrondissement in which the proposed cinema development is to be located or his/her representative; c) A councillor from the arrondissement in which the proposed cinema development is to be located or his/her representative;
c) An arrondissement councillor appointed by the Paris City Council;
d) A deputy mayor of Paris;
e) A regional councillor appointed by the Ile-de-France regional council;
2° Three people with expertise in film distribution and exhibition, sustainable development and regional planning.
The Commission hears any person likely to be able to enlighten its decision.
IV – The person qualified in film distribution and exhibition mentioned in 2° of II and III is proposed by the Chairman of the Centre national du cinéma et de l’image animée from a list drawn up by him.
