Article L213-6 of the French Cinema and Moving Image Code

The Film Ombudsman refers to the Autorité de la concurrence any practices prohibited by articles L. 420-1, L. 420-2 and L. 420-5 of the French Commercial Code that come to his attention in the film distribution sector. This referral may be made under an emergency procedure, in accordance witharticle L. 464-1 of the French Commercial Code.

The mediator may also refer any competition-related matter to the Autorité de la concurrence for an opinion, in accordance witharticle L. 462-1 of the French Commercial Code.

The Autorité de la concurrence shall inform the Cinema Ombudsman of any referral concerning cinema distribution. It may also refer any matter falling within its remit to the mediator.

Article L213-6

Le médiateur du cinéma saisit l’Autorité de la concurrence des pratiques prohibées par les articles L. 420-1, L. 420-2 et L. 420-5 du code de commerce dont il a connaissance dans le secteur de la diffusion cinématographique. Cette saisine peut être introduite dans le cadre d’une procédure d’urgence, conformément à l’article L. 464-1 du code de commerce.

Le médiateur peut également saisir l’Autorité de la concurrence, pour avis, de toute question de concurrence dans le cadre de l’article L. 462-1 du code de commerce.

L’Autorité de la concurrence communique au médiateur du cinéma toute saisine concernant la diffusion cinématographique. Elle peut également saisir le médiateur de toute question relevant de sa compétence.
