Article L2143-1 of the French Public Health Code

For the purposes of this Chapter, the notion of third-party donor means the person whose gametes have been collected or retrieved pursuant to Chapter IV of Title IV of Book II of Part One of this Code, as well as the couple, the surviving member or the unmarried woman who has consented to one or more of her embryos being received by another couple or another woman pursuant to Article L. 2141-5.

Where the third-party donor is a couple, their consent means the express consent of each of their members.

Pour l’application du présent chapitre, la notion de tiers donneur s’entend de la personne dont les gamètes ont été recueillis ou prélevés en application du chapitre IV du titre IV du livre II de la première partie du présent code ainsi que du couple, du membre survivant ou de la femme non mariée ayant consenti à ce qu’un ou plusieurs de ses embryons soient accueillis par un autre couple ou une autre femme en application de l’article L. 2141-5.

Lorsque le tiers donneur est un couple, son consentement s’entend du consentement exprès de chacun de ses membres.
