Article L2143-6 of the French Labour Code

In establishments employing fewer than fifty employees, the trade unions which are representative in the establishment may appoint, for the duration of his term of office, a member of the staff delegation to the social and economic committee as a trade union delegate.

Unless provided for by agreement, this mandate does not give entitlement to a time credit. The time available to the member of the staff delegation to the social and economic committee for the exercise of his mandate may be used under the same conditions for the exercise of his duties as trade union delegate.

Dans les établissements qui emploient moins de cinquante salariés, les syndicats représentatifs dans l’établissement peuvent désigner, pour la durée de son mandat, un membre de la délégation du personnel au comité social et économique comme délégué syndical.

Sauf disposition conventionnelle, ce mandat n’ouvre pas droit à un crédit d’heures. Le temps dont dispose le membre de la délégation du personnel au comité social et économique pour l’exercice de son mandat peut être utilisé dans les mêmes conditions pour l’exercice de ses fonctions de délégué syndical.
