Article L2153-2 of the French Public procurement code

Where a tender submitted in connection with the award of a supply contract by a contracting entity contains products originating in third countries with which the European Union has not concluded, within a multilateral or bilateral framework, an agreement ensuring comparable and effective access for European Union undertakings to the markets of those countries, or to which the benefit of such an agreement has not been extended by a decision of the Council of the European Union, the tender may be rejected where products originating in third countries represent the majority share of the total value of the products making up the tender, under conditions laid down by regulation.
Where two or more tenders are equivalent in terms of the award criteria, preference may be given to one of them under conditions laid down by regulation.

Article L2153-2

Lorsque une offre présentée dans le cadre de la passation d’un marché de fournitures par une entité adjudicatrice contient des produits originaires de pays tiers avec lesquels l’Union européenne n’a pas conclu, dans un cadre multilatéral ou bilatéral, un accord assurant un accès comparable et effectif des entreprises de l’Union européenne aux marchés de ces pays, ou auxquels le bénéfice d’un tel accord n’a pas été étendu par une décision du Conseil de l’Union européenne, cette offre peut être rejetée lorsque les produits originaires des pays tiers représentent la part majoritaire de la valeur totale des produits composant cette offre, dans des conditions prévues par voie réglementaire.
Lorsque deux ou plusieurs offres sont équivalentes au regard des critères d’attribution, une préférence peut être accordée à l’une d’entre elles dans des conditions prévues par voie réglementaire.
