As stated in article 511-19-2 of the French Criminal Code, which is reproduced below:
Art. 511-19-2 -The following is punishable by two years’ imprisonment and a fine of 30,000 Euros:
“1° Conserving embryos or embryonic stem cells without having obtained one of the authorisations or made one of the declarations mentioned in Article L. 2151-9 of the Public Health Code or when this authorisation has been withdrawn or suspended or when the Director General of the Agence de la biomédecine has suspended or prohibited storage pursuant to the penultimate paragraph of the same Article L. 2151-9;
” 2° Conserving embryos or embryonic stem cells without complying with the rules mentioned in the third or penultimate paragraphs of the said Article L. 2151-9;
“3° Transferring embryos or embryonic stem cells to organisations that have not declared their research project to the Agence de la biomédecine in accordance with Article L. 2151-6 of the same Code or that do not hold an authorisation issued pursuant to Articles L. 2151-5 or L. 2151-9 of the said Code or who have not declared their embryonic stem cell conservation activities in accordance with the penultimate paragraph of the same Article L. 2151-9;
” 4° Having transferred embryos or embryonic stem cells without first informing the Agence de la biomédecine. “
