Article L217-23 of the French Consumer Code

The producer may grant the consumer a commercial guarantee committing him for a given period of more than two years, known as a “commercial guarantee of durability”. If he offers such a commercial guarantee of durability, the producer is under a direct obligation to the consumer to repair or replace the goods for the period indicated in the offer of the commercial guarantee of durability; he is also under an obligation to implement the guarantee under the same conditions as the legal guarantee.

The producer may offer the consumer more favourable conditions than those described in the offer.

Article L217-23

Le producteur peut consentir au consommateur une garantie commerciale l’engageant pendant une période donnée, supérieure à deux ans, dénommée “ garantie commerciale de durabilité ”. S’il propose une telle garantie commerciale de durabilité, le producteur est directement tenu, à l’égard du consommateur, de réparer ou de remplacer le bien, pendant la période indiquée dans l’offre de garantie commerciale de durabilité ; il est également tenu de mettre celle-ci en œuvre dans des conditions identiques à la garantie légale.

Le producteur peut offrir au consommateur des conditions plus favorables que celles décrites au premier alinéa.

Les exigences prévues à l’article L. 217-22 sont applicables à la garantie commerciale de durabilité.
