If the consumer wishes performance of a service or contract mentioned in the first paragraph of Article L. 221-4 begins before the end of the withdrawal period provided for in article L. 221-18 and if the contract places the consumer under an obligation to pay, the trader shall obtain the consumer’s express request by any means for contracts concluded at a distance and on paper or on a durable medium for contracts concluded off-premises. He shall ask the consumer to acknowledge that once he has fully performed the contract, he will no longer have the right of withdrawal.
The consumer who has exercised his right of withdrawal from a contract for the provision of services or from a contract referred to in the first paragraph of Article L. 221-4, the performance of which has begun, at his express request, before the end of the withdrawal period, shall pay the trader an amount corresponding to the service provided up to the communication of his decision to withdraw; this amount shall be proportionate to the total price of the service agreed in the contract. If the total price is excessive, the appropriate amount shall be calculated on the basis of the market value of what has been supplied.
No sum shall be owed by the consumer who has exercised his right of withdrawal if his express request has not been collected pursuant to the first paragraph or if the trader has not complied with the information obligation provided for in 9° of Article L. 221-5.
