Article L221-26 of the French Consumer Code

The consumer who has exercised his right of withdrawal from a contract for the supply of digital content without a physical medium shall not owe any sum if:
1° The trader has not obtained the consumer’s prior express agreement to perform the contract before the end of the withdrawal period and proof that the consumer has acknowledged losing his right of withdrawal after the contract has been fully performed at the consumer’s express request;
2° The contract does not include the information provided for in the third paragraph of Article L. 221-9 and the second paragraph of article L. 221-13.

Article L221-26

Le consommateur qui a exercé son droit de rétractation d’un contrat de fourniture de contenu numérique sans support matériel n’est redevable d’aucune somme si :
1° Le professionnel n’a pas recueilli son accord préalable exprès pour l’exécution du contrat avant la fin du délai de rétractation ainsi que la preuve que le consommateur a reconnu perdre son droit de rétractation après que le contrat aura été pleinement exécuté à la demande expresse de celui-ci ;
2° Le contrat ne reprend pas les mentions prévues au troisième alinéa de l’article L. 221-9 et au second alinéa de l’article L. 221-13.
